2. Eligibility

3. Accounts

- You are responsible for your account and all activity under it.

- We may suspend or terminate accounts for violations of these Terms, non-payment, or abuse of the Service.
4. Description of Service
Varya provides tools to:
- Upload audio.
- Generate audio-reactive visualizations.
- Export video content.
The Service is a technical tool only. We do not review or control user-generated content.
5. User Content
5.1 Ownership. You retain full ownership of your content.
5.2 License to Varya. You grant us a limited license to:
- Process your content.
- Generate outputs.
- Store content as required to provide the Service.
5.3 Responsibility. You are solely responsible for your content. You represent that you own or have rights to the content and that your content does not violate laws or third-party rights.
6. Copyright and DMCA Policy
If you believe that any content on the Service infringes your copyright, you may submit a takedown request by contacting:

Your request must include:
- Identification of the copyrighted work.
- Description of the infringing content.
- Location, URL, or details of the content.
- Your contact information.
- A statement of good faith belief that the use is unauthorized.
We may remove or disable access to content that is alleged to be infringing.
7. Acceptable Use
You may not:
- Upload illegal or infringing content.
- Violate intellectual property rights.
- Reverse engineer or exploit the platform.
- Disrupt or interfere with the Service.
8. Payments and Subscriptions
Payments are processed via Stripe.
8.1 Billing. Paid features require payment. You authorize charges to your payment method.
8.2 Subscriptions. Subscriptions automatically renew. Billing occurs at the start of each cycle.
8.3 Cancellation. You may cancel anytime. Access continues until the end of the billing period.
8.4 Refunds. All payments are non-refundable, unless required by law.
8.5 Price Changes. We may change pricing with notice. Continued use implies acceptance.
8.6 Stripe Terms. Your use of payments is subject to Stripe's terms. We are not responsible for payment processing errors.
9. Third-Party Services
The Service depends on third-party providers. We are not responsible for outages or failures caused by these services.
10. Service Availability
We may:
- Modify or discontinue features.
- Impose limits, including usage, storage, and exports.
- Interrupt service for maintenance.
We do not guarantee uninterrupted service.
11. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". We make no warranties regarding reliability, accuracy, or availability.
12. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect or consequential damages.
- Our total liability is limited to the amount you paid in the last three (3) months.
13. Indemnification
You agree to indemnify and hold harmless Varya from any claims arising from:
- Your use of the Service.
- Your content.
- Your violation of these Terms.
14. Data Retention and Deletion
We retain data in accordance with our Privacy Policy. Upon account deletion:
- Your account data will be deleted within 30 days.
- Stored content may also be deleted within this timeframe.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
16. Force Majeure
We are not liable for failure or delay in performance due to events beyond our reasonable control, including but not limited to:
- Internet outages.
- Cloud infrastructure failures.
- Natural disasters.
- Government actions.
17. Changes
We may update these Terms. Continued use constitutes acceptance of changes.
